These Terms and Conditions (Terms) govern use of www.peakpotentiallc.com.au (Site) and purchases of the goods and services offered through it. The Site is owned and operated by Michael John Flanagan, trading as Peak Potential Life Coaching (we, us, our). Please read these Terms before using the Site or purchasing an assessment or service.

By using the Site or placing an order, you agree to these Terms. Nothing in these Terms excludes, restricts or modifies rights or remedies that cannot lawfully be excluded, including under the Australian Consumer Law (ACL).

1. INTELLECTUAL PROPERTY AND PERMITTED USE

Unless otherwise stated, Site content, branding, images, text, assessment instruments, scoring materials, documents and downloadable files are owned by Michael John Flanagan or used with permission from their respective owners. All applicable intellectual-property rights are reserved.

Purchasing a PPP assessment grants the purchaser and intended participant a limited, non-exclusive, non-transferable licence to download and use the supplied assessment for that individual’s personal assessment, subject to any additional written licence terms. You must not reproduce, redistribute, publish, resell, adapt, reverse-engineer or commercially administer PPP materials without prior written permission, except as permitted by law. You may retain your own completed assessment and report for personal reference.

2. ACCEPTABLE USE AND ACCOUNTS

You must use the Site lawfully and must not interfere with its operation, attempt unauthorised access, misuse another person’s information, or distribute protected materials without permission.

A purchaser must be at least 18 years old. Where the intended PPP participant is under 18, a parent or guardian must arrange or authorise the purchase and review the relevant information and consent materials with the young person. The young person’s participation and information sharing arrangements are addressed in those materials and our Privacy Policy.

You are responsible for providing accurate, current contact information and billing details during checkout. We may restrict access to the Site or services where reasonably necessary to respond to unlawful activity, misuse or a material breach of these Terms, subject to applicable law.

3. PPP ASSESSMENTS AND COACHING SERVICES

The Site offers Performance Pressure Profile (PPP) self-assessments and information about coaching services. Available products, inclusions, prices and any eligibility conditions are described on the relevant product or booking page at the time of purchase.

PPP is an educational and coaching-oriented self-report profile. It is not a clinical diagnosis, emergency service or substitute for assessment or treatment by a suitably qualified health professional. Reports are descriptive and should be considered in context. If completing an assessment causes distress, the participant may pause or stop and seek appropriate support as outlined in the Information and Consent Form provided with the purchase. Coaching appointments, where purchased or booked, are subject to the booking information and any additional service agreement or consent provided before the session.

4. ORDERS, PRICES AND PAYMENT

All prices are displayed in Australian dollars (AUD), with any applicable taxes or additional charges disclosed at checkout. Unless otherwise stated, a one-off assessment purchase is payable in full when ordered.

WooCommerce administers orders and Stripe processes all online payments. The payment method offered at checkout is Stripe card payment. Your payment and contact information (email address and billing details) are collected and processed through Stripe’s secure systems during checkout.

By submitting an order, you authorise Stripe to charge the displayed total to your card. You will receive an order confirmation at the email address you provide at checkout. We may decline or cancel an order for a legitimate reason, including suspected fraud, payment failure or product unavailability; if we cancel an order after receiving payment, we will refund the amount paid for the cancelled item, subject to applicable law.

5. DELIVERY, CONSENT AND ASSESSMENT SUBMISSIONS

For online PPP assessments, the usual process is: purchase → allocation of a unique Assessment ID → authorised workbook and consent-form download → completion → secure website upload → administrative notification → retrieval by Peak Potential Life Coaching. Download availability and any completion instructions will be communicated via email to the address provided at checkout.

Assessment workbooks and related forms are provided through protected WooCommerce downloads. Additional server-level restrictions are being configured to prevent direct public access to protected downloadable files. Completed workbooks are to be submitted through the website’s secure HTTPS upload facility, rather than as email attachments.

Please follow the relevant Information and Consent Form. A student’s name is not required within the completed workbook; the Assessment ID links it to your order and email address. The purchaser must not complete an assessment on another person’s behalf or submit responses without the participant’s appropriate agreement.

6. COMPLIMENTARY INFORMATION SESSIONS AND SUBSCRIPTIONS

Where advertised, a complimentary PPP information or introductory coaching session is a no-obligation service, not a subscription or automatically converting free trial. Booking availability and any cancellation or rescheduling arrangements are shown during booking.

A one-off PPP assessment purchase does not create a recurring subscription. If a separate subscription product is introduced, its price, billing frequency, renewal arrangements and cancellation terms will be disclosed before purchase and will apply only if expressly accepted.

7. CANCELLATIONS, REFUNDS AND CONSUMER GUARANTEES

We offer a voluntary satisfaction arrangement for PPP assessment purchasers: if dissatisfied with the information provided by a purchased PPP assessment, contact us within seven days of receiving access to the assessment workbook and materials, explain the concern and request a refund. We will review the request promptly and may offer assistance or a full refund under this voluntary arrangement. Please retain the order number or Assessment ID.

This seven-day arrangement is additional to, and does not limit, any rights under the ACL. Australian consumers may be entitled to remedies if goods or services fail to meet applicable consumer guarantees, regardless of whether seven days have passed or a digital file has been downloaded. Any mandatory remedy will be provided in accordance with the law.

For separately booked coaching services, cancellation and rescheduling arrangements will be stated at booking or in the relevant service agreement. Contact us if an order or download is incorrect, inaccessible, or defective.

8. PRIVACY AND SECURITY

We handle purchaser and participant information in accordance with our Privacy Policy and the relevant assessment Information and Consent Form. Payment information is collected during checkout and processed through Stripe; card details must not be entered into a PPP workbook or submitted via any other channel.

Website and assessment security measures, including protected WooCommerce downloads, HTTPS-encrypted checkout and upload processes, and server-level file protection, are described in our Privacy Policy. No online transmission or storage method can be guaranteed entirely risk-free. Please notify us promptly if you believe your download or assessment information has been compromised.

9. WEBSITE INFORMATION AND LIABILITY

We take reasonable care to keep Site descriptions and materials accurate and current, but information may change. We do not guarantee uninterrupted access or that the Site will be free of every technical error. If you encounter a problem with a purchased product, please contact us so it can be addressed.

To the extent permitted by law, we are not responsible for loss caused by misuse of the Site, unauthorised modification of materials, or events outside our reasonable control. Nothing in this section excludes or limits any consumer guarantee, statutory right, or liability that cannot lawfully be excluded or limited. We do not require users to provide a broad indemnity for merely using the Site.

10. GOVERNING LAW AND GENERAL PROVISIONS

These Terms are governed by the laws of New South Wales, Australia, subject to any mandatory rights that apply elsewhere. If any provision is found invalid or unenforceable, the remaining provisions continue to operate to the extent permitted by law.

Our failure to enforce a provision on one occasion does not waive our ability to enforce it later. Any additional terms for a particular product or coaching service will be disclosed before purchase; if there is an inconsistency, mandatory law prevails.

11. CHANGES AND CONTACT

We may update these Terms to reflect changes to the Site, products, operations or legal requirements. The current version and effective date will appear on the Site. Material changes affecting existing purchases will be communicated where appropriate and will not retrospectively remove mandatory rights.
